Under the MS4 permit requirements, the City and County have implemented a program regarding temporary construction storm water quality controls, effective October 1, 2001.

On February 19, 2013, the Texas Commission on Environmental Quality (TCEQ) issued a new TPDES general permit for storm water discharges from construction activities (TPDES General Permit No. TXR150000). Further information on the state requirements can be obtained from TCEQ's website (see link at right).

TPDES General Permit No. TXR150000 includes permit requirements for small construction sites as well as large construction sites. Operators of construction sites that will disturb five or more acres or that are part of a common plan of development or sale that will disturb five or more acres (large construction sites) must submit a TCEQ notice of intent (NOI) form to TCEQ. Operators of construction sites that will disturb one or more acres but less than five acres or that are part of a common plan of development or sale that will disturb one or more acres but less than five acres (small construction sites) must post a Construction Site Notice.

Copies of NOIs and Construction Site Notices must also be submitted to the operator of the MS4 receiving the storm water discharges. For projects discharging to the City, County, HCFCD or TxDOT MS4, the NOIs and Construction Site Notices should be sent to the appropriate agency's permitting office. For projects discharging to the County or HCFCD MS4, send forms to the Permit Office of the Harris County Public Infrastructure Department - Engineering Division. Operators of both large and small construction sites must develop and implement a storm water pollution prevention plan.
